Our Areas of Practice
Focused legal counsel across seven core areas, serving individuals, families, and businesses throughout Kenya from our offices in Nanyuki.
Family Law
Family law matters are among the most emotionally demanding situations a person can face. Whether you are navigating a divorce, disputing custody of a child, or seeking protection from domestic violence, A.W Ndung'u Law Advocates brings both legal rigour and genuine empathy to every family matter.
We advise and represent clients across the full range of family law proceedings before the Magistrates' Court and the High Court — including matrimonial causes, applications for custody and access, maintenance claims, and the division of matrimonial property under the Matrimonial Property Act, 2013.
We also assist with adoption proceedings, applications for protection and occupation orders under the Protection Against Domestic Violence Act, 2015, and guardianship matters. Our approach is always to seek the outcome that best serves our client and, where children are involved, their welfare above all else.
Conveyancing & Property
Land and property transactions in Kenya require careful legal navigation — from due diligence searches at the land registry to the drafting of sale agreements, the obtaining of land control board consents, and the registration of title transfers. Errors or omissions at any stage can result in costly disputes or the loss of title.
A.W Ndung'u Law Advocates guides buyers, sellers, landlords, and tenants through the full conveyancing process under the Land Registration Act, 2012 and the Land Act, 2012. We conduct land registry searches, prepare and review sale agreements and transfer documents, facilitate consent applications, and attend to registration.
We also advise on and resolve property disputes, including boundary disputes, adverse possession claims, and disputes over leases and tenancy agreements. Whether you are purchasing your first plot, selling commercial property, or resolving a neighbour dispute, we will ensure your property interests are protected.
Civil Litigation
Civil litigation encompasses the wide range of disputes that are resolved through the courts rather than by criminal process — from straightforward debt recovery to complex multi-party contract disputes, applications for injunctions, and appeals to the Court of Appeal.
Alice has substantial experience in civil court proceedings before the Magistrates' Courts, the High Court, and the Employment and Labour Relations Court. She has represented both plaintiffs and defendants in contract disputes, tortious claims, debt recovery actions, and applications for judicial review.
Our approach to litigation is grounded in preparation. We invest time in understanding the full factual and legal picture before advising on the prospects of success, and we keep our clients informed at every stage of the proceedings. Where an early resolution through negotiation or mediation is possible and in the client's interest, we will say so candidly.
Employment Law
Employment disputes can be acutely disruptive — for employees who have lost their livelihood and for employers navigating complex obligations under Kenyan law. A.W Ndung'u Law Advocates advises and represents both employees and employers across the full range of employment law matters.
For employees, we handle wrongful and unfair termination claims, applications to the Employment and Labour Relations Court (ELRC), disputes over severance and terminal dues, and matters arising from discriminatory treatment or harassment in the workplace. We also advise on the interpretation and enforcement of employment contracts and collective bargaining agreements.
For employers, we provide guidance on compliant employment contract drafting, lawful disciplinary and termination procedures, redundancy processes under the Employment Act, 2007, and representation before the ELRC when disputes arise. Early advice from employment counsel is nearly always less costly than litigation — we are here for both.
Criminal Law
A criminal charge — regardless of the offence alleged — is one of the most serious challenges a person can face. The consequences of conviction can include imprisonment, fines, and a permanent criminal record that affects employment, travel, and reputation. It is essential to have experienced legal representation from the earliest possible stage.
A.W Ndung'u Law Advocates provides criminal defence representation at all stages of the criminal process in Kenya — from the initial charge and bail application through trial, sentencing, and appeal. Alice has experience in a range of criminal matters, including offences against the person, property offences, economic crimes, and road traffic offences.
We take every criminal instruction seriously. Our approach involves a thorough review of the prosecution evidence, honest advice on the prospects of each defence strategy, and assertive advocacy in court. We also advise on the possibility of plea negotiations where this is in the client's best interest, and on mitigation to be presented in sentencing proceedings.
Corporate & Business Law
Sound legal foundations are essential for any business in Kenya — whether you are a sole trader formalising your enterprise, a partnership seeking a clear operating agreement, or a company undertaking a major commercial transaction. A.W Ndung'u Law Advocates provides practical, commercially minded legal advice to businesses at every stage of their development.
Our corporate and business law work covers company registration and compliance under the Companies Act, 2015, the drafting and review of commercial contracts, partnership and shareholders' agreements, and ongoing retainer advisory for businesses that want regular access to legal counsel.
We also advise on business restructuring, asset transfers, and the legal aspects of business acquisitions. Our approach is to provide advice that is clear, practical, and focused on the client's commercial objectives — not advice that creates complexity where simplicity would serve better.
Succession & Wills
Planning for the distribution of your estate is one of the most important steps you can take for your family's future — yet it is a step that many Kenyans postpone. A properly drafted will ensures that your assets pass to the people you intend, minimises disputes among beneficiaries, and simplifies the administration of your estate.
A.W Ndung'u Law Advocates advises on the preparation of wills under the Law of Succession Act, including wills that account for customary law rights, property held jointly, and assets distributed across different counties. We also act as advocates in succession proceedings — obtaining grants of probate and letters of administration before the High Court, and administering estates on behalf of personal representatives.
Where succession disputes have arisen — whether about the validity of a will, the rights of dependants, or the proper administration of an estate — we represent clients in contested succession proceedings. These matters require sensitivity as well as legal skill, and we bring both.
